Willits News: Railroad [yards] declared a nuisance

The city sent the North Coast Railway Authority a Notice of Nuisance on January 25 declaring the rail yard including the various railcars to be a public nuisance. The city has received no response from the NCRA as of press time.

In the notice, the city cites the poor security at the rail yard and calls the 20 railcars an attractive nuisance to vandals and persons seeking shelter.

The area poses “an unreasonable risk of serious injury to persons who access them [the cars] as well as to the law enforcement and fire department crews who respond to calls.” The rail yard is also called a visual blight with detrimental effect on the neighborhood.

The nuisance declaration requires the NCRA begin correcting the situation by February 1, adequately secure the cars by February 24 with complete removal of all cars within 90 days.

The immediate remedy requested is for NCRA to hire on-site security personnel to patrol the yard until the removal of the cars and/or until the cars have been adequately fenced or secured with steel panels or doors to the satisfaction of city personnel, followed by complete removal of the 20 railcars from the city.

The NCRA has 15 days to appeal the notice. Under the municipal code, the city may fine the NCRA $300 per day up to $100,000 for failing to comply with the nuisance notice.
